Bervet Studio licence agreement

The end-user licence agreement (EULA) for the app.

This agreement is between you and Bervet, which makes Bervet Studio and is run from New South Wales, Australia. It covers the Bervet Studio app on every device you use it on, and its updates. By installing or using the app you agree to it. If you don't agree, don't install or use it.

Your Bervet account, if you have one, is covered by the website's terms of use (bervet.com/terms). What the app sends to Bervet, and why, is in the privacy policy (bervet.com/privacy).

Using the app

Bervet gives you a licence to install and use Bervet Studio on your own devices, to plan, write, design and publish your own work, and work you do for others (a co-author, a client, a publisher). You can sell what you make with it. The licence isn't exclusive, and you can't pass it on.

Registering

You can use every part of the app without registering, for as long as you like, with or without a Bervet account. While it isn't registered it reminds you to register, now and then; the reminders never stop anything from working.

Registering, once it opens, is a licence for one person that doesn't run out. It covers up to two computers at a time, keeps working offline, and takes the reminders away. To move it to another computer, free one up in the app or on your account page. A registration is for you: don't share it, sell it or give it away.

The cloud (syncing, the phone and tablet app, sharing a book with someone), once it's offered, comes with its own terms, which you'll see before you sign up. Nothing else in the app depends on it.

Your work is yours

What you write, draw, design or make with Bervet Studio belongs to you (or to whoever it belonged to before). Bervet claims no rights over it. It stays on your device: Bervet only gets what you choose to send it (a listing, an advance copy, a beta read or a problem report, for example), uses it only for what you sent it for, and the privacy policy says how.

The fonts, templates, stamps, decorations and other artwork that come with the app are yours to use in what you make with it, including books you sell. The fonts are under the SIL Open Font License, which allows that; just don't sell the font files themselves.

What you can't do

Parts made by others

Bervet Studio includes open-source software, fonts and dictionaries made by other people. Each comes under its own licence, and those licences ship with the app. Nothing in this agreement limits what they let you do with those parts.

Updates and the internet

The app works without the internet. If you installed it from bervet.com, it looks for a new version at most twice a day while you're online and installs one only when you say so; a copy from the Microsoft Store is updated by the Store. Updates can add, change or retire features. If Bervet ever stops making updates, the app you have keeps working, and so does a registration.

Keep your own backups

Your books and files are kept on your device, not on Bervet's servers, so keeping copies is up to you. Back up regularly (in the app: Settings, Back up every book) and keep the backup somewhere else as well: another drive, or a cloud folder.

No guarantees

Bervet works hard to make the app reliable, but it's provided as it is, without promises beyond the ones the law gives you. As far as the law allows, Bervet isn't liable for any loss from using the app or not being able to, including lost work, files, sales or income.

Nothing in this agreement excludes, restricts or changes your rights under the Australian Consumer Law, or the consumer rights that the law where you live won't let anyone sign away.

Ending it

You can stop using the app whenever you like. If you seriously break this agreement (selling copies, say, or getting around the registration check), Bervet can end your licence and any registration. What you made with the app stays yours.

Changes

This agreement may change. If a change matters, it's announced on bervet.com before it takes effect. A change never takes back a registration you already have.

Law

This agreement is governed by the law of New South Wales, Australia. If you live somewhere else, you keep the protections of the law there that can't be signed away.
